In California, a law was passed that prohibited sex offenders from decorating their houses and passing out candy for Halloween.  Sounds fair right?  Do the crime, get the punishment.  Would you want your child to be enticed to go up to a sex offenders house for trick or treating because their house is decorated?

Some sex offenders are taking offense to this.  As 5 convicted sex offenders sue Simi Valley, CA, claiming the new law "violates their 1st amendment right to free speech".

If you really want to get technical about it, the law does indeed violate their right to free speech.  They are expressing themselves through decoration in the spirit of Halloween.

On the other hand though, I really do see why this law would be passed.  Sex offenders could be decorating their houses in order to be eye catching for children.  Then, when it's time to trick or treat, innocent kids aimlessly walk up to the house of a sex offender to get candy, and as horrible as it is to say, get more than candy.  Some people are sick!  These sex offenders could be lacing candy with a drug or even kidnapping children!

I think about the law, and I really don't think there is any middle ground at all.  Maybe they could just decorate their houses and not pass out candy.  What's to keep them from passing out candy?  What's to keep children from approaching their houses?  Are there going to be police officers posted up at every sex offenders house?  Is there anyway to give them their "freedom of speech" and still keep children out of danger?

Are these people just suing because they see a chance to make a quick buck?

Is there a point when you have to disregard the 1st amendment and just say no?

Do people change?
