One man was hospitalized after a shooting that took place yesterday at Smokey Joe's Texas Cafe, located at 2903 W 6th in Amarillo.  The shooter claims he opened fire with his .380 in self-defense, after the victim attacked him.  The wounded man was taken to the hospital via an ambulance and was believed to have life-threatening injuries.  However, his condition has improved, and officials now believe he suffered a none life-threatening injury.

"On 4-9-14, at 5:36 PM, officers were sent to Smokey Joe’s Texas Café at 2903 W. 6th on a shooting.  Responding officers found a WM 37on the west parking lot, suffering from a gunshot wound to the abdomen.  People at the scene were rendering first aid.  Officers learned that he had been shot by another man who was still present on the lot.  This man, a WM 49, identified himself to officers as being involved and disclosed that he was in possession of the .380 caliber handgun he used in the incident.  He told officers that he fired in self-defense after the suspect attacked him, knocked him down, and was striking him in the face repeatedly with his fist.  Investigating officers interviewed witnesses and reviewed surveillance camera video of the shooting.   The man was interviewed by detectives and released pending additional investigation and referral of the case to the 47th District Attorney’s Office.  The wounded man was taken to the hospital by ambulance.  His injury was initially believed to be life-threatening, but his condition has improved and is not now considered life-threatening."

It has not been officially ruled as self-defense, pending additional investigation.
